Panday v Virgil [2008] UKPC 24, [2008] All ER (D) 120 (Apr)

When an appeal against conviction is allowed on the ground of apparent bias in the conduct of the trial, the Court of Appeal may order a retrial if the defendant was properly charged and brought before the court without any
violation of the rule of law and it is possible to have a fair retrial before a different tribunal.
