Flight delays & missed connections with non-EC carriers: Mark Walker reports

  • Passengers entitlement to compensation under the Denied Boarding Regulation for delay in respect of “missed connections”.
  • An analysis of whether the passenger holding a “through-ticket” is entitled to compensation based on the length of delay arriving at the passenger’s final destination if the intermediate airport is outside the EC and the carrier is a “non-community carrier”.

This problem concerns passengers’ entitlement to compensation under Art 7 of EC Reg 261/2004 (the “Denied Boarding Regulation”) for delay in respect of “missed connections”, whereby a short delay on the first flight leaving an EC airport, results in the passenger missing his or her connecting flight, usually causing a long delay arriving at the passenger’s final destination.
