The courts will need to cancel public sector and utility contracts awarded in breach of EU public procurement rules, under new draft legislation published by the UK Office of Government Commerce (OGC) for the implementation of the EU Directive known as the “Remedies Directive”. A breach could include failing to publish a contract notice in the EU official journal and entering into a contract in breach of the mandatory 10-day standstill period.
