McMenemy v Capita Business Services Ltd [2007] CSIH 25, [2007] IRLR 400

An employer who operates a policy of not giving part-time workers days off in lieu for bank holidays falling on a Monday if they did not normally work on Mondays does not discriminate unlawfully contrary to the Part-Time Workers (Prevention of Less Favourable Treatment) Regulations 2000 (SI 2000/1551).
