Kontic and others v Ministry of Defence [2016] EWHC 2034 (QB), [2016] All ER (D) 31 (Aug)

The Administrative Court dismissed the claim of the claimant widows and mother of Serbs abducted or murdered in Kosovo, following the deployment of the international military coalition (KFOR) authorised by United Nations. On the basis of Behrami v France; Saramati v France (Applications 71412/01 and 78166/01), the acts and omissions alleged against the defendant Ministry of Defence were attributable to the UN, not to the UK.
