EBay is not liable for the sale of counterfeit products on its UK website. In L’Oréal and others v eBay and others [2009] EWHC 1094 (Ch), L’Oréal claimed eBay was not doing enough to police its website and that the company should be jointly liable for the sale of counterfeits along with the sellers themselves. However, the court ruled that eBay had “no legal duty or obligation to prevent infringement of third parties’ registered trade marks”.
