Wilkes v DePuy International Limited [2016] EWHC 3096 (QB), [2016] All ER (D) 121 (Dec)

The Queen’s Bench Division held that the defendant was not liable to the claimant pursuant to s 3 of the Consumer Protection Act 1987 for the failure of the claimant’s C-Stem, inserted as part of an artificial left hip. The claimant had failed to establish that the C-Stem supplied to him had suffered from a defect.
