Worth bearing in mind that the compensation limit under the ombudsman scheme run by the Office of Legal Complaints has risen from £30,000 to £50,000 as from 1 February 2013. And take a look at the lovely model directions finally up on www.justice.gov.uk/courts/procedure-rules/civil/standard-directions for multi-track claims and incorporate the suggested warning notice—“You must comply with the terms imposed upon you by this order otherwise your case is liable to be struck out or some other sanction imposed. If you cannot comply you are expected to make formal application to the court before any deadline imposed upon you expires.”
Inevitably, there will be satellite litigation and the Court of Appeal will tackle cases reaching it through a coterie of judges including Lord Dyson MR and Stephen Richards LJ. At least one of the judges will sit on all the important appeals which should aid consistency.
